Terms And Conditions

This Try Account Terms Addendum (“Try Terms”) governs access to and use of Skyflow’s Services under a free, no-charge evaluation or demonstration account (“Try Account”). These Try Terms are incorporated into and made part of the Skyflow Terms of Use & Master Agreement found at www.skyflow.com/terms-of-service (the “Master Terms”). Capitalized terms not defined herein have the meanings given in the Master Terms.

By accessing or using a Try Account, Customer agrees to these Try Terms.

If there is a conflict between these Try Terms and the Master Terms, these Try Terms control with respect to Try Accounts.

  1. No Order Form; Evaluation Use Only
    Notwithstanding anything in the Master Terms to the contrary:
    • No Order Form is required for a Try Account.
    • Sections of the Master Terms relating to Order Forms, fees, payment obligations, Subscription Terms, automatic renewals, pricing adjustments, or true-up rights do not apply to Try Accounts.
    • The Try Account is provided solely for Customer’s internal evaluation, testing, and non-production purposes.
    • The Try Account confers no right to continued access, production deployment, or commercial use.

      Skyflow may impose technical or usage limits on Try Accounts in its discretion.

  2. Free of Charge; No Support; No SLA
    The Try Account is provided free of charge.
    Skyflow has no obligation to provide:
    • Support Services,
    • Professional Services,
    • Service levels,
    • Uptime commitments, or
    • Maintenance obligations

      with respect to a Try Account.
      The Try Account may be modified, suspended, or terminated at any time, with or without notice.

  3. No Production Data
    Customer shall not upload, process, store, or transmit through a Try Account:
    • Production data,
    • Live operational data,
    • Personal data of end users,
    • Regulated data (including without limitation PHI, PCI data, financial account data, or other sensitive regulated information), or
    • Any data used in Customer’s live commercial environment.

      For purposes of these Try Terms, “Production Data” means any data used or intended for use in Customer’s live business operations or containing real customer, employee, patient, financial, or end-user information.
      Customer is solely responsible for ensuring that all data used in a Try Account is synthetic, anonymized, test, or sample data.
      If Customer uploads Production Data in violation of this Section:
      • Such data shall be deemed “Customer Data” under the Master Terms.
      • Customer assumes all risk and liability arising from such use.
      • Skyflow shall have no liability arising from or related to such prohibited data upload.
  4. Skyflow Access and Debugging Rights
    Customer acknowledges and agrees that, notwithstanding any restrictions in the Master Terms:
    • Skyflow personnel may access, review, use, reproduce, analyze, and modify data uploaded to a Try Account for purposes of operating, debugging, testing, supporting, and improving the Services.
    • Skyflow may use data from Try Accounts in aggregated or de-identified form for product development, analytics, benchmarking, and service improvement.

  5. Data Processing Addendum
    The Data Processing Addendum (DPA) referenced in the Master Terms does not apply to Try Accounts.
    Customer agrees that Skyflow is not acting as a data processor under applicable data protection laws with respect to Try Account data.
    If Customer requires data protection commitments, Customer must execute an Order Form and transition to a paid subscription.

  6. Security; Backups
    Skyflow may apply different security, segregation, retention, and backup practices to Try Accounts than to paid subscriptions.
    Skyflow has no obligation to:
    • Retain data after termination,
    • Provide data export functionality, or
    • Maintain backups of Try Account data.

      Upon termination of a Try Account, Skyflow may immediately delete all associated data.
  7. Warranties; Disclaimer
    The Try Account is provided strictly on an “AS IS” and “AS AVAILABLE” basis.
    Without limiting the disclaimers in the Master Terms:
    • Skyflow makes no representations or warranties regarding the performance, availability, functionality, or security of the Try Account.
    • The Try Account may contain beta features, experimental functionality, or incomplete components.
    • Skyflow disclaims all liability arising from Customer’s reliance on or use of the Try Account.
  8. Termination
    Skyflow may terminate or suspend a Try Account at any time for any reason or no reason.
    Upon termination:
    • Customer shall immediately cease use of the Try Account.
    • Skyflow may delete all data without obligation to retain or return it.

      Customer may request conversion to a paid subscription, which shall require execution of an Order Form and acceptance of the full Master Terms.
  9. No Commercial Rights; No Reliance
    A Try Account does not:
    • Grant production rights,
    • Establish pricing commitments,
    • Create exclusivity,
    • Create a partnership or agency relationship, or
    • Obligate Skyflow to offer the Services on any particular terms in the future.
  10. Incorporation of Master Terms
    Except as expressly modified herein, all provisions of the Master Terms remain in full force and effect and apply to Try Accounts.
